July 16, 2010)(Westlaw subscription required to access Westlaw), a Federal Court denied a Motion to Remand a UM Bad Faith Claim. The Court held that, under Florida law, a Bad Faith Claim is separate from a Claim on an Insurance Policy. Love, 2010 WL 2836172 at *2. In the Court's view, therefore, it is proper to remove a Bad Faith Claim to Federal Court and leave the adjudication of the Coverage Claim, here, the UM Claim, to the State Court in which a Jury had already returned a Verdict in excess of the UM Policy Limits.
