Secrecy has long been a sign of those whose deeds are done without public awareness. It has also long been a concern of Courts and Legislatures forced to address various issues including Good Faith or Bad Faith involved in "confidential" settlement agreements. The demonstrated concerns of the Florida Legislature in this area, for example, were analyzed in posts here on May 23, 2007 and June 10, 2007, with links to other sources as well.
The Courts of Florida are now actively addressing related concerns by Rule. Florida Rule of Judicial Administration 2.420(d) was written for example to address numerous concerns over sealing a laundry list of information contained in Court records.
Florida Rule of Judicial Administration 2.420(d) became effective October 1, 2010.
