It was held in B.S.C. Holding, Inc. v. Lexington Ins. Co., 625 F. App'x 906 (10th Cir. 2015), that Kansas law would require enforcement of a clearly stated one-year limitations period in a commercial insurance contract even without a showing of prejudice by the carrier.
