The filed rate defense is not about the filed rates, it's about filed rates that are approved. That includes insurance rates, if there is any chance to convince a Court that the filed rate doctrine applies to insurance rates at all. See Dane v. UnitedHealthCare Ins. Co., 401 F. Supp. 3d 231, 239 (D. Conn. 2019) ("Because he is seeking relief for an injury allegedly caused by the payment of a rate on file with a regulatory commission, Dane's claims are barred by the filed rate doctrine.").
