FIFTH CIRCUIT MOTION PANEL ORDER REINSTATING TEXAS ABORTION STATUTE FOUND!

After a long search, I have found the Fifth Circuit's Order of October 8, 2021 reinstating the Texas abortion ban statute.  Following recent Fifth Circuit precedent, the Order was issued by a three-judge motions panel without an opinion and without briefing or oral argument.  Technically, the Order is in effect until the Fifth Circuit disposes of the 'emergency' motion to stay the statute pending appeal.

          The United States has been ordered to file a response by Tuesday, October 12, 2021.
