The case of Dent v. Nat'l Football League, No. C 14-02324 WHA, 2021 WL 4817749 (N.D. Cal. August 31, 2021) is a class action by former football players against the NFL alleging improper administration of pain medications. As required by the terms of the Stipulated Protective Order the parties wrote in the case, the players filed a motion to have the Court seal the exhibits to their motion for certification of their class, for the sole reason that the NFL designated all those documents "confidential."
The absurdity of such a common provision in SPOs became clear when the NFL did not file anything in support of the sealing request. The NFL lost; the exhibits are not sealed.
Reference to a stipulated protective order is insufficient to establish that the documents are sealable. Civ. L.R. 79-5(d)(1)(A). The NFL has not filed a declaration in support of sealing.
Therefore, the motion is DENIED.
