Federal District Judge MATTHEW J. KACSMARYK in Texas was nominated twice by the Grievance Guy and finally was sworn in the second time, in 2019.
Previously, Judge Kacsmaryk ruled that President Biden needed to keep the Grievance Guy's previous position that immigrants need to be outside the United States when they apply for asylum.
This represents one ruling in a disturbing trend of federal decisions for Catholic lawyers like me. My faith regards this kind of willful infliction of cruelty as sinful. It is surprising to see judges ruling in defense of cruelty.
Even though Judge Kacsmaryk self-identifies as a Catholic, the Catholics on the U.S. Supreme Court overruled him in that case.
Judge Kacsmaryk's latest ruling is cut from the same cloth as his earlier ruling, it appears. His latest ruling is that lesbians, gays, bisexuals, transgender people and queers/questioners have no protection against discrimination. The U.S. Equal Opportunity Commission or EEOC issued Guidance following a United States Supreme Court decision that held to the contrary, i.e., that LGBTQ people are entitled to the same protections against discrimination as other Americans everywhere in the United States.
It will be interesting to see how the Supreme Court's current majority of Ratzinger Catholics rule now, whether they rule as this Texas judge did rendering people defenseless to discriminatory cruelty, or whether they follow their own precedent as the EEOC tried to do.
