Hiding the names of the plaintiffs in a Federal lawsuit is generally a losing proposition. A recent announcement of this state of the case law came in Does v. Mills, 39 F.4th 20, 25 (1st Cir. 2022), voluntarily dismissed by stipulation, No. 22-1435, 2022 WL 17367462 (1st Cir. July 14, 2022), 'the case of the putative pseudonymous plaintiffs': "Those circuit courts that have considered the matter have recognized a strong presumption against the use of pseudonyms in civil litigation."
These issues are analyzed in first-party cases in 2 DENNIS J. WALL, LITIGATION AND PREVENTION OF INSURER BAD FAITH § 9:28.100 (3d Edition West Publishing Company, 2023 Supplements in process). Similar issues arising in third-party cases are discussed in 1 id., § 3:107.100.
